Case No: 07012314MM10A - BROWARD COUNTY - JUDGE SEIDMAN - February 2008 |

Facts: My client was stopped for speeding by Deputy Mohammed. After making generic DUI observations, my client was offered and failed the roadside tests. He was asked to take a breath test and blew .179/.170. |
|
Result: I filed a motion to exclude the breath test results because on the video, my client repeats that he will take the breath test, but also wants a blood test. The law in Florida states that if you take a breath test and ask for a blood test, the officer has a duty to help you obtain a blood test. In this case, the officer did not allow him to get a blood test. Based on this issue, the State reduced the charge from DUI to a reckless driving. |

Case No: 052007CT055233 - BREVARD COUNTY - JUDGE ATKINS - February 2008 |

Facts: My client was stopped for speeding. He failed the roadside tests and refused the breath test. |
|
Result: The officer video taped the stop and the arrest. On video, the first thing the officer asks my client is if he knows how fast he was going. When my client responded that he did not know, the officer replied o, I can just lie to you and make up a number. The officer also says on video that he was going to take my client to the town center to hang him up the flag pole in his underwear. After explaining to the State that I was planning on turning the trial into a trial against the officer ridiculous comments and behavior, she reduced the charges against my client from DUI to reckless driving. |

Case No: 0530XDK - MIAMI- DADE COUNTY - JUDGE ORTIZ - January 2008 |

Facts: My client was stopped for speeding on 140th and Collins Avenue by Bal Harbor Police Department. A second officer arrived on the scene and conducted the roadside tests. My client failed the roadside tests and refused the breath test. |
|
Result: I took the depositions of the two officer involved in this case. The officer who made the stop said that the second officer assisted him in making the stop and that my client refused all roadside tests. This was dramatically different from the statement from the second officer who said in his deposition that he arrived on the scene after the stop was already made and that my client performed one of the roadside tests. I showed the transcripts of both depositions to the State Attorney who then dismissed the DUI. |

Case No: 07020427MM10A - BROWARD COUNTY - JUDGE ROBINSON - January 2008 |
|
Facts: My client was stopped for speeding by Deputy Herbert of the DUI TASK FORCE. The Deputy observed bloodshot, glassy eyes and my client stated he had a couple beers. He failed all of the roadside rests and blew .047/.045. |
|
Result: Two days after the arrest, my client went and paid for an independent drug test to show that he did not have any illegal drugs in his system. A few weeks after I filed motions on this matter, the State Attorney dismissed the DUI. |

Case No: 2041-XAV - MIAMI-DADE COUNTY - JUDGE MILLS-FRANCIS December 2007 |

Facts: My client hired me after he was placed on probation for a previous DUI charge. While on probation, he was re-arrested for a new DUI charge and this violated his probation. |
|
Result: The warrant that had been filed for his arrest did not mention the new DUI arrest and at the Violation of Probation Hearing, the State dismissed the warrant and his probation was successfully terminated. |
